The RRC Authority (the “Authority”) is a public corporation and political subdivision of the State of Colorado, created by the RRC Authority Establishment Agreement dated April 6, 2023, by and between the RRC Metropolitan District Nos. 1, 2, 4, 5, and 6 (“Districts”) as it may be amended from time to time (the “Establishment Agreement”), under Sections 29-1-203 and 203.5, C.R.S. The Authority has been established for the purpose of financing and installing street, park and recreation, water, sanitation, transportation, mosquito control, safety protection, and television relay and translation improvements within the service area of the Districts; and all other improvements or services permitted by Article 1, Title 32, C.R.S. and the Establishment Agreement (collectively, the “Public Improvements and Services”), except as specifically limited by the Amended and Restated Service Plan for the Districts approved by the Board of County Commissioners of Jefferson County on August 23, 2022 as may be amended from time to time (the “Service Plan”) and the Establishment Agreement. The Public Improvements and Services are for the use and benefit of the residents and taxpayers within the service area of the Authority and the Districts. The Authority is located in Jefferson County, Colorado. The Authority may issue debt, but is limited to the same amount of debt that the Districts, collectively, may issue. The Authority may, combined with the Districts, incur a maximum debt of $50,000,000. Ad valorem property taxes, specific ownership taxes, and any other legally available moneys may be used to repay such debt. The Authority does not impose a debt service mill levy. The Districts may assess, as adjusted for statutory or legislative changes on or after January 1, 2016, a maximum mill levy of fifty (50) mills to repay such debt issued by the Authority. Per separate agreements between the Districts and the Authority, the Districts agree to pledge their revenues to the Authority. The Authority must file an Annual Report to the Jefferson County Clerk and Recorder, Jefferson County Board of County Commissioners, the State Auditor, and the Division of Local Government. The Authority does not have boundaries, but the Districts’ boundaries overlap with the boundaries of Jefferson County, Mount Carbon Metropolitan District, Urban Drainage and Flood Control District, Urban Drainage and Flood District South Platte, Regional Transportation District, West Metro Fire Protection District, and Jefferson County R-1 School District. The Districts appoint representatives of their respective Boards to serve on the Authority Board of Directors in accordance with the Establishment Agreement.
